What issues might you run into in a dog bite case in California?

Although many people think of dogs as loyal pets, the fact is that dogs can sometimes turn hostile in a heartbeat, regardless of what breed they might be. Some of our readers may think that it is just so-called “aggressive” breeds that you have to worry about—like pit bulls, for example—but while that breed can often be quite dangerous, other dogs can attack people and cause serious injuries as well.

So, if you have been the victim of a dog attack and you decide to take legal action, what issues might you run into in your case? Well, each case is different, with different factual scenarios to consider, but there are some common themes that arise in dog attack cases.

For example, the issue of who, exactly, owns the dog might come up—it is the dog’s owner who will usually be held responsible for an attack that causes injury to another person. Or, there may be an issue about whether the dog’s owner knew that the dog in question had a “propensity” for violent or aggressive behavior. And, yet another common question is whether the dog was “provoked” into attacking the injured victim.
